From the SMH this afternoon....
Sydney United has been reinstated into the NSW Premier League's 2005 season after the NSW Supreme Court today ruled it was not given a fair hearing.
Soccer NSW suspended the Croatian-backed Sydney United for four consecutive games, ruling it out of the NSW Premier League 2005 finals, for not doing enough to prevent a riot between its supporters and those of the Serbian-backed Bonnyrigg White Eagles, on March 13.
Justice Robert McDougall today declared that decision void but said Soccer NSW still had the right to discipline the club, provided it gave the club the right to be heard on any charges and proposed penalty.
The judge also will hear this afternoon argument from both sides on whether teams who were awarded forfeited points as a consequence of the suspension will have to replay those games.
An independent inquiry found Sydney United did not do enough to prevent the riots.
Justice McDougall today agreed with lawyers representing Sydney United that the club had been denied procedural fairness because although its representatives were interviewed about the riot they were not notified of the "particular charges".
He said they also should have been given the opportunity to be heard on the punishment.
"Therefore I conclude that the plaintiff has made out its case for relief," he said.
The hearing continues.

Well some would argue that the fans should be punished, not the club. I think it's a good move, but Soccer NSW needs a review.
