i'll take a wild punt (having worked for a student organisation in the past) that there is a clear process through which the employer must progress to dismiss an employee - repeated breaches of policy would certainly be included if the requisite warnings are given, and action would be taken under a process agreed between the organisation, the union and the staff member (who explicitly accepted the rules by signing the employment contract). except you wouldn't sack a worker for making a mess in the kitchen! wrongfull dismisal is very costly and the commission would tell you to piss off..... believe me - i'm on the worker's side of pretty much any dispute you can point at, but consistent breaches of policy met with the appropriate process will invalidate any unfair/unlawful dismissal action. unlawful dismissal in particular isn't just hard to defend ($$$ wise), it's hard to prosecute, so people aren't going to take it on without there having been due cause, and if your boss has followed the agreed process you're going nowhere at thousands of dollars a day in the federal court. unfair dismissal won't apply soon anyway so rule that out. in any case, mick's a good fella, and as i see it he's being perfectly reasonable: if you set a rule you might as well enforce it - it affects not merely the aesthetics and amenity of the workplace but also the OH&S side. can i call game set and match now? |

What annoys me....threads about nothing in the 'other stuff' section that boost people's (mick's and omni's) post counts when my goal in life is clearly to be the number one forum gun. Oh wait..I just started posting in one! Yay!
